Welcome to Mzansi Marketplace Seller Program. By registering as a Seller, you agree to these Terms and Conditions, forming a legally binding agreement with Mzansi Marketplace ("Platform"), a South African registered company. These terms govern your use of the Platform for listing, selling, and managing transactions.
We comply with the Consumer Protection Act (CPA) No. 68 of 2008, Protection of Personal Information Act (POPIA) No. 4 of 2013, and Electronic Communications and Transactions Act (ECTA) No. 25 of 2002.
1. Seller Eligibility
You must be at least 18 years old and provide accurate business and personal details during registration, including ID verification. Misrepresentation leads to immediate termination.
2. Seller Responsibilities
You are responsible for:
- Accurate and honest products listings, per National Consumer Commission v Takealot (2021), avoiding misleading claims.
- Ensuring products meet safety and quality standards under the CPA.
- Processing, fulfilling, and delivering orders promptly.
- Handling returns and refunds per your policy, compliant with CPA Section 56.
- Complying with POPIA when handling buyer data, obtaining consent before sharing.
3. Payments and Fees
Payments are processed via Yoco, with funds held until withdrawal. You’ll link a valid bank account for payouts, subject to commission fees based on your Subscription Plan (viewable in your Dashboard). Withdrawals are secure, with AES-256 encryption, and processed within 72 hours.
4. Platform Role
The Platform is an intermediary, not responsible for products quality, fulfillment, or delivery disputes. We facilitate communication and process payments but are not liable for seller-buyer disputes.
5. Termination
We may terminate your account for violations like fraud or misleading listings. You may terminate by contacting support, settling pending orders. Data is retained for 5 years post-termination per the Tax Administration Act.
6. Dispute Resolution
Resolve disputes with buyers directly. If unresolved, escalate to support for mediation under CPA. Unresolved disputes may proceed to the Arbitration Foundation of South Africa (AFSA). Contact the Consumer Goods and Services Ombud at info@cgsosa.co.za.
7. Amendments
We may update these terms, notifying you via email or Dashboard with 30 days’ notice per CPA. Continued use constitutes acceptance.
